By downloading, installing, or using ZestShot, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.
1. Description of Service
ZestShot is an iOS application that uses artificial intelligence to enhance food photography. You upload photos through the App, and our cloud-based AI processing transforms them into professional-quality food images.
2. Account Registration
- You must create an account to use the App. You may sign in with Apple, Google, or email/password.
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when creating your account.
- You must be at least 13 years old to use the App.
3. Subscriptions and Payments
- ZestShot offers auto-renewable subscription plans (weekly and monthly) that unlock premium features.
- A free 3-day trial is available for new subscribers. You will not be charged during the trial period.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
- You can manage and cancel your subscription in your Apple ID Account Settings.
- Any unused portion of a free trial period will be forfeited when you purchase a subscription.
- Prices are in the currency of your App Store account and may vary by region.
4. User Content
- You retain ownership of any photos you upload to the App.
- By uploading photos, you grant us a limited license to process them using our AI enhancement service.
- You represent that you have the right to upload any content you submit and that it does not violate any third party's rights.
- AI-processed images are derived works created by our service based on your original photos. You may use the processed images for personal and commercial purposes.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Upload content that is illegal, harmful, or violates others' rights
- Attempt to reverse-engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's services or servers
- Use automated means to access the App beyond normal usage
- Share your account credentials with others
6. AI-Generated Content
- The App uses Google Gemini AI to process and enhance photos. Results may vary and are not guaranteed to meet specific expectations.
- AI processing is performed on cloud servers; your photos are transmitted to third-party AI services for processing.
- We do not guarantee that AI-generated results will be free of artifacts or errors.
7. Intellectual Property
The App, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
8. Disclaimers
- The App is provided “as is” without warranties of any kind, express or implied.
- We do not guarantee uninterrupted or error-free service.
- We are not responsible for any loss of data, including uploaded or processed photos.
- AI enhancement results depend on input quality and may not always produce desired outcomes.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
10. Termination
- You may stop using the App and delete your account at any time.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, your right to use the App ceases and your data may be deleted.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Continued use of the App after changes constitutes acceptance.
